Redistribution: You will not redistribute or facilitate the redistribution of any Fat City Properties information and content. If you are a domain broker, dealer, agent, or investor, you agree not to use the content provided by Fat City Properties for any purpose related to your business without written permission from Fat City Properties.
Sale of Domains: There shall not be a binding agreement to sell or a binding agreement to purchase or lease a domain name unless and until Fat City Properties, LLC (hereinafter “the Seller”) sends an “Offer Price” to the buyer, stating that the price upon which the Seller will sell the domain name in question. The Buyer is in no way obligated to purchase a domain unless the Buyer agrees to the Offer Price and sends its acceptance of the Offer Price back to the Seller. An Offer Price made to a Buyer by the Seller or any price quoted by the Seller to the Buyer is only valid for a seven day (7) period from the date that the Offer Price is e-mailed to the Buyer. Within such seven (7) day period, the Buyer must accept the Offer Price in writing and pay the Seller the full purchase price via one of the payments methods offered in FAQ page. If the Seller has agreed to a lease or lease purchase of the domain name in question, the Buyer must sign and return our standard lease or lease purchase agreement along with the first month’s payment within seven (7) days of the Seller emailing such lease agreement. In the event the Buyer fails to accept the Seller’s Offer Price within the seven day period as detailed herein, then the Sellers Offer Price will be deemed null and void.
The Seller’s Prices are subject to change at any time, without notice and the posted prices found on our website or other domain aftermarket websites, may not reflect our most recent price. All domain names are subject to prior sale. The Seller shall transfer the domain to the Buyer within 7 business days, upon payment in full by the Buyer. Owner financed domains will be transferred within 20 days upon completion of the final payment from the Buyer to the Seller. The Seller shall not be responsible for any registrar delays in transferring a domain.
Registration Fees: The Buyer shall receive the remaining term of the registration as it appears in the Whois record of the domain after purchasing a domain. The Buyer is responsible for paying all registration fees associated with the purchase of a domain. The seller has no responsibility or liability to pay any domain registration fees after the domain is transferred to the Buyer.
Taxes: The Buyer is responsible for any taxes levied with regard to their purchase of a Domain Name from Fat City Properties LLC and also agrees to be bound by the terms and conditions of ICANN’s Uniform Domain Name Dispute Resolution Policy (UDRP).
Intellectual Property: The Fat City Properties trademark, logo, trade name, software, databases, reports, website and all information contained therein are proprietary, and Fat City Properties retains all rights, title and interest therein. The use of any of the services provided by Fat City Properties does not give any rights or licenses over the assets, rights or licenses of Fat City Properties to the user in any way.
Fat City Properties is unaware of any third party that may own a trademark whether registered or common law, or other rights that may be identical, related or similar to any domain name available for purchase on this site. We have made no investigation as to whether any of the Domains we have for sale infringe on any third party rights and we make no representations or warranties, regarding the same. All domain name buyers assume any risk of liability with respect to trademark infringement. We strongly advise all of our customers to conduct their own due diligence and seek their own counsel to determine any legal risks connected to the purchase or use of a Domain Name.
Interference: You will not attempt to hinder or interfere with the operation of our website in any way nor will you enable or allow another to do so. You will not try to impose any disproportionate or unreasonably large load on our servers or attempt to email us any malicious material, software, viruses or anything else that could damage or interfere with our hosting, servers, websites, or computer systems.
Warranty: Fat City Properties, LLC does not make any warranty as to the results that may be obtained from the use of any of our products or services. You agree that the use of any of our products or services is at your sole risk and that our products and services are provided on an “as is” and an “as available” basis.
